2021 Concessions Agreement for The Woodlands High School Band Boosters

The Woodlands High School Band Boosters (Boosters) and the individual named below (Worker) agree to the following terms and conditions regarding contract labor to be performed. The Boosters have entered into a contractual agreement with Aramark, whereby the Boosters provide individuals to work concessions at various events. The Boosters make time slots available to individuals who wish to earn money to help pay the cost of participation in marching band/color guard/choir/theater/orchestra. Acceptable costs that may be offset with concession earnings are band fees, student travel fees, and parent chaperone travel fees. If sufficient time slots are available, the Boosters also allow individuals to work and donate their earnings to the Boosters. Workers are expected to arrive on time and in uniformed so that everyone may participate in getting the booth ready for a show. Workers are also expected to provide at least 48 hour notice if they can no longer fill their shift, absent exceptional circumstances.

Since the work program is intended to assist individuals in paying marching band costs, the Boosters prohibit cash payments directly to any Worker and accordingly, acceptable costs shall not include the expense of a new instrument.

The compensation received by the Boosters from Aramark is based on a percentage of concession sales for each event. The total money from each pay period is divided among the workers for each pay period, based on the number of shifts worked by each individual. The Boosters do not receive any portion of the compensation for providing this work opportunity to the Workers.

Compensation received by the Worker may be credited to a TWHS Band Student's account and used to offset Band obligations, or may be donated to the TWHS Band for all students benefit.

Credit to Account

Income earned under this agreement will be credited to the Student account designated below. Worker understands that all compensation under this agreement is subject to Federal Income Tax. Worker is an Independent Contractor, and is not an employee of either the Boosters or Aramark. As such, compensation earned in each calendar year is reportable by the Boosters to the IRS on Form 1099-MISC if the total exceeds specified IRS limits. Worker understands that it is their responsibility to report all compensation earned under this agreement, regardless of whether a Form 1099-MISC is issued or not. Worker must provide a properly completed Form W-9 in order to received compensation. In the absence of a properly completed W-9, it is understood that all compensation earned will be credited to the general band fund.

Donate to Band

Worker declines being compensated for services under this agreement, and donates their earnings to the TWHS Band Booster Club for the benefit of all TWHS Band students.
