ELEMENTARY SCHOOL PARENTS’ CONTRACT 2021-2022
By signing this enrolment contract as parent/guardian of the student named on the cover page (the “Student”), you agree to accept the terms and conditions set out herein, including all documents incorporated by reference (collectively, the “Contract”).
UMCA Rich Tree Academy (“UMCA” or the “School”) aims to provide a safe, family-like environment. All parents/guardians are expected to respect the educational philosophy of the School, as well as the professional decisions made by the School teachers. Should any parent treat a School staff member disrespectfully (i.e., verbal attacks, threats, or harmful accusations), the School reserves the right to terminate the family's School enrolment contract(s), should this be deemed necessary by the School Administration. Upon termination of the Contract, it is expected that parents/guardians abide by the following expectations:
1.1. You agree that you will not speak about UMCA Rich Tree Academy in a defamatory manner. This includes statements that are hurtful, untrue, and ones that tend to discredit the reputation of our School.
1.2. You agree that you will not contact teachers outside of the school environment. This includes soliciting teachers as a way to gather information or obtain tutoring support.
2.1. Hours of operation are 8:00AM – 6:00PM.
2.2. The School requires one month’s prior written notice from parents/guardians for contract termination. However, there will be no refund for the payments made to UMCA.
2.3. Our website www.umca.ca is the primary way the School communicates with parents/guardians. Please do not forget to check our website weekly.
2.4. The School has the right to amend and/or enforce policies and regulations which improve the quality of education, health and safety of our students. This may be done at anytime during the academic school year.
2.5. Health and Safety Protocols:
(a) As long as COVID-19 guidelines are in place, masks are mandatory for Grade 4 students and up. For students who are unable to wear a face covering, please provide a medical exemption form which will be assessed by the School Administration.
(b) UMCA will provide its updated COVID-19 health and safety protocols, including UMCA’s expectations of parents/guardians and students for the 2021-2022 school year, to parents/guardians prior to the commencement of the school year (the “Plan”). As parent/guardian of the Student, you confirm that you will read the entirety of UMCA’s Plan and that you understand the importance of cooperation by parents/guardians and members of the school community in ensuring a healthy and safe return to school. You hereby acknowledge and understand that the Plan is subject to change based on applicable public health guidance, legislation and directives, and that notice of amendments will be shared by UMCA. You acknowledge and agree that it is your responsibility to review these amendments as may be issued from time to time. You hereby confirm that you will comply with and will reinforce to the Student for her/his compliance, the expectations of UMCA with respect to the Plan and the 2021-2022 school year as they may be amended from time to time. You further agree to comply with public health guidance as they may be amended from time to time for the 2021-2022 school year. You understand and agree that misrepresentation regarding the information you provide to UMCA could result in exclusion of the Student from UMCA.
2.6. Medical notes should be submitted at time of registration. UMCA has the right to accommodate medical exemption letters at its sole discretion. The School Administration will thoroughly review the application requests for a medical exemption.
2.7. UMCA has the right to refuse service for any student and/or families who do not comply with our rules.
2.8. Contracts are subject to change from year to year and the fees and stipulations are exclusive of one another.
2.9 The admission of the Student at UMCA is conditional until the Student’s enrolment for the 2021-2022 school year is confirmed in writing by the School Administration. Enrolment confirmations will be provided to parents/guardians prior to the first day of classes.
The first day of term one is September 9th, 2021.
The last day of the school year is June 24th, 2022.
The School will be closed on all Statutory and Civic Holidays as required by law.
In addition, the School will be closed on Thursday, September 16th, 2021.
Thanksgiving: October 11, 2021.
Winter Break: December 20th, 2021 – December 31st, 2021 (first day back to School after Winter Break is January 3rd, 2022).
Family Day: February 21st, 2022.
The School will be open during March Break from March 14th until March 18th, 2022.
Easter: April 15th – 18h, 2022.
Victoria Day: May 23rd, 2022.
When scheduling family vacations, please remember that May 15 – June 15 is the period of exams and graduations. Please avoid booking trips during this time.
Summer Camp is from July 4th – September 2nd. Registration forms for Summer Camp will be uploaded to the website.
4.1. A late pick-up fee of $1 a minute will be charged if a child is not picked up from UMCA Rich Tree Academy by 6:00 pm. This also applies to all part-time students.
5.1. The Tuition Fee for the school year is $1,700.00 per month.
The Tuition Fee for the school year for Early Bird registration until March 1st, 2021 is $1,600.00 per month.
5.2. $300.00 - Registration Fee for each new enrolled student is payable by the registration date.
5.3. $600.00 – The Supplies Fee will be used to purchase books, school, and art supplies for the entire school year. The Supplies Fee must be paid on the registration day.
5.4. $300.00 – Winter Celebration Fee of $100, organized tours to Theaters and Educational Centers $100, and Historical Tourism Activities Fee of $100 is payable November 1st, 2021.
5.5. $300.00 – Other educational fees as follows, payable by September 1st, 2021:
A. Educational mandatory excursions fee $216 (8 trips at $27 per trip) B. Sport uniform: UMCA T-shirt $7 for each term. ($14)
C. Graduation fee: includes yearbook ($30) and hoodies ($40).
***End of year optional overnight trip (includes bus transportation, 24-hour teacher supervision and night chaperon, educational activities, 7 meals and 2-night stay) - a $300 trip fee payable by June 1st, 2022.
5.6. Where parents/guardians have enrolled more than one (1) child at UMCA for the school year, the Siblings Discount may be applied by UMCA to the child with equal or lesser Tuition Fee, provided that the child is or will be at least 4 years of age before December 31st of that school year.
The Siblings Discount is exclusive from year to year and families are entitled to one (1) discount per year, where applicable. Where applicable, the Siblings Discount is applied to the monthly Tuition Fee of the child with equal or lesser Tuition Fee as follows: 10% discount for the 2nd child, 50% discount for 3rd child, or 4th child is free of charge. For greater clarity, these discounts cannot be combined.
For illustrative purposes only, where a family has enrolled three children who are all 4 years of age or older as of December 31st, the 3rd child will receive a 50% discount and the other children are charged full Tuition Fee amounts.
5.7. $100 – The Educational Assessment is mandatory for new students and incoming Grade 1 students. This must be done in the month of August, prior to the first day of school.
6.1. Upon signing the Contract, you must e-transfer to email@example.com the following fees:
- One-month Tuition Fee - This non-refundable deposit will be applied towards the Tuition Fee for June 2022. When you e-transfer do not forget to state the Student’s full name and the grade he/she registers for in the message field.
- Registration Fee - $300.00 (Only for first time registering new students)
- Educational Assessment Fee - $100.00 (Only for new students and incoming Grade 1 students)
- Supplies Fee - $600.00.
6.2. Upon registration you must complete the Pre-Authorized Debits form attached in Appendix A to this Contract or bring/email (firstname.lastname@example.org) a Direct Deposit form or a void cheque by August 15, 2021 to the UMCA office.
7.1. The Tuition Fee for the school year is payable in nine (9) pre-authorized debits of $1,600.00 ($1,700.00 after March 1, 2021) for each of the nine months (September through May, inclusive). The payment will be debit from your account on the first of each month. Cheque or Cash payments cannot be accepted.
7.2. Attention: there are no sick or vacation days in UMCA Rich Tree Academy. Monthly payments must be made regardless of whether a child is absent from school for any reason.
7.3. Any payments made under this Contract that are rejected or returned due to insufficient balance, must be replaced for the outstanding amount, plus $20.00 processing fees.
7.4. You hereby acknowledge that you have received, read and fully understood the Student Handbook and you agree to follow its guidelines.
8.1. UMCA reserves the right at its sole discretion to suspend or resume any or all in-person activities and programs from time to time pursuant to applicable public health guidance, legislation and directives. UMCA may continue to provide Remote Learning subject to the Force Majeure section below. “Remote Learning” may be comprised of synchronous (real-time) and asynchronous online learning, temporarily or indefinitely as part of the whole class instruction, in smaller groups of students, and/or in a one-on-one context for the 2021-2022 school year. For greater clarity, UMCA reserves the right at its sole discretion to terminate Remote Learning at any time during the school year. Notwithstanding that the Contract is being signed during the COVID-19 crisis, all parties will continue to comply with the terms of the Contract. For greater clarity, in the event that UMCA is required to close its physical locations and facilities and/or students are prohibited from returning to the campus of UMCA during the 2021-2022 school year pursuant to the Reopening Ontario (A Flexible Response to COVID-19) Act, 2020, S.O. 2020, c. 17 and its regulations, or pursuant to COVID-19 outbreak measures, you hereby agree that you will continue to comply with your obligations in the Contract, including the obligation to pay fees to UMCA.
8.2. As parent/guardian of the Student, you hereby acknowledge and agree that UMCA reserves the right at its sole discretion to suspend the obligations in the Contract for the period of time that a condition of Force Majeure exists. “Force Majeure” means an act of God, strike, lock-out, act of public enemy, war, blockade, pandemic, and civil disturbance, or other causes beyond the reasonable control of UMCA such as to make Remote Learning impossible or impracticable, as determined solely by UMCA. UMCA shall immediately notify parents/guardians of any suspension due to a Force Majeure event. UMCA and parents/guardians agree to use their best efforts to eliminate the effects of the Force Majeure event and to resume performance of the Contract as soon as possible after the Force Majeure event ceases. UMCA is not liable for any costs incurred by parents/guardians due to delays or non-performance of obligations as a result of the Force Majeure event.
9.1. This Contract shall be governed by and continued in accordance with the laws of the Province of Ontario and the laws of Canada applicable herein. The parties attorn to the exclusive jurisdiction of the courts of the Province of Ontario and all courts competent to hear appeals therefrom.
9.2. The Contract (including any documents incorporated by reference) constitutes the entire agreement between the parent/guardian of the Student and UMCA concerning the subject matter herein. It shall supersede all prior agreements, understandings, representations, or contracts between the parents/guardians of the Student and UMCA concerning the subject matter hereof, whether verbal or written, including, without limitation, any prior enrolment or re-enrolment contract executed by the parent/guardian and UMCA. No amendment, supplement, restatement or termination of any term of the Contract, save and except for amendments to the Plan, rules, regulations, policies, guidelines and schedules of UMCA, shall be binding upon the parties unless it is in writing and signed by the parties.
9.3. Failure or delay by a party to this Contract to exercise, in whole or in part, any of their rights, powers or remedies in the Contract is not a waiver of those rights, powers or remedies. No waiver shall be effective unless it is in writing and signed by the party asserted to have granted such waiver.
9.4. The parent/guardian of the Student may not assign, or otherwise transfer, their rights or delegate their duties or obligations under the Contract without prior written consent of UMCA. Any attempt to do so is void. The Contract shall ensure to benefit and bind the parties hereto, their successors and permitted assigns.
9.5. In the event that any part of any provision of the Contract may prove to be illegal or unenforceable, the other provisions of the Contract and the remainder of the provision in question shall continue in full force and effect.
9.6. The Contract may be executed in counterparts and/or by electronic signature and if so executed shall be equally binding as an original copy of the Contract executed in ink by the parent/guardian of the Student.

Please complete the Pre-Authorized Debit (PAD) Plan agreement below.
I/We authorize UMCA Rich Tree Academy, and the financial institution designated (or any other financial institution I/We may authorize at any time) to begin deductions as per my/our instructions for monthly regular recurring payments and/or one-time payments from time to time, for payment of all charges arising under my/our UMCA Rich Tree Academy account. Regular monthly payments for the full number of services delivered will be debited to my/our specified account on the 1st day of each month.
UMCA Rich Tree Academy will obtain my/our authorization for any other one-time or sporadic debits.
This authority is to remain in effect until UMCA Rich Tree Academy has received written notification from me/us of its change or termination. This notification must be received at least thirty (30) business days before the next debit is scheduled at the School office.
UMCA Rich Tree Academy may not assign this authorization, whether directly or indirectly, by operation of law, change of control or otherwise, without providing at least 10 days prior written notice to me/us.
I/We have certain recourse rights if any debit does not comply with this agreement. For example, I/we have the right to receive reimbursement for any PAD that is not authorized or is not consistent with this PAD agreement. To obtain a form for a Reimbursement Claim, or for more information on my/our recourse rights, I/we may contact my/our financial institution or contact the office at UMCA Rich Tree Academy.
