The undersigned (hereinafter called the “Applicant”) hereby applies for membership in, and agrees to purchase energy and/or services from Logan County
Cooperative Power & Light Association, Inc. (hereinafter called the “Cooperative”), upon the following terms and conditions;
Acceptance of this application for membership by the Cooperative shall constitute an agreement between the Applicant and the Cooperative, and shall become effective on the date service is first made available, and shall remain in effect until terminated by either party. This membership is not assignable or transferable except as provided by the Code of Regulations of the Cooperative.
The Applicant agrees to comply with and be bound by the provisions of the Articles of Incorporation and Code of Regulations of the Cooperative and such Rules and Regulations may from time to time be adopted by the Cooperative.
The Applicant will permit the Cooperative to perform a background credit check prior to service being established subject to the Cooperative’s policies and procedures. The Cooperative may require a cash deposit as security for payment if the Applicant does not meet the credit standards established by the Cooperative, when electric service is shut-off for non-payment or in case of bankruptcy. Failure to provide adequate security for payment will result in denial or discontinuance of electric service subject to applicable laws.
Applicant will, subject to the laws of the United Stated and the State of Ohio, purchase from the Cooperative all electric energy and/or other related services used on the premises described below and will pay therefore monthly rates which will be fixed by the Board of Trustees. This clause does not prohibit the use of the Cooperative’s power as a backup to solar, wind, biomass, or other unique renewable fuel sources.
The Cooperative retains the right to terminate this agreement and discontinue service when any indebtedness incurred by this member is not satisfied after notice of such delinquency has been given by the Cooperative. It is understood that all equipment installed in or about the premises by the Cooperative to provide service is and shall remain the property of the Cooperative, and the Cooperative, its agents and employees are expressly authorized to enter upon the premises to remove said equipment when service is no longer required or when default of payment for same results and such removal is permitted by law.
The Applicant agrees to the deduction annually from their equity in the assets of the Cooperative as payment for their subscription to the Ohio Cooperative Living magazine.
Applicant grants to the Cooperative the right and easement over any part of the premises described below to install, operate, maintain, repair and remove any part of the Cooperative’s electric and/or communication system to properly maintain the supply of service, and to do all things incidental or necessary thereto, including, without limitation, cutting, trimming and controlling the growth of vegetation that may interfere with or threaten to endanger the operation and maintenance of said system.
Applicant can choose a single or a joint membership. In a joint membership, both applicants are members and both share in the accumulation of Capital Credits, either can be a trustee, both are jointly liable for the service yet share only one vote.
