TERMS OF RENTAL (MINIMUM 3 MONTHS)
1) All rental fees are due in advance each month. Rental for any part of a month is considered rent for an entire month. Renter may return the Instrument and terminate the agreement any time after having fulfilled the three-month minimum rental provided all payments are current at the time of return. NO REFUNDS WILL BE AWARDED. 2) Rental Return Fee is the equivalent of 1 month’s rent with all applicable coverage’s and taxes. This fee is used to recondition, adjust, and clean the above rented instrument to its pre-rental condition. It is not a repair coverage fee. Any repairs required may be charged. The rental return fee is non-refundable. 3) Recurring Billing, I authorize La Habra/Corona Music Center to keep my signature on file and to charge my credit card account, on an ongoing basis for amounts I owe. I understand that this authorization is valid for the length of the contract. I also agree to contact the merchant if there are any changes to my credit card account information. 4) If any payment is not paid by the due date, the Renter agrees to pay a $25.00 late fee. Fees are subject to change without notice. 5) If payments become 30 days delinquent, LH/CMC may, at its own option, charge the Renter’s credit card(s) for all amounts currently due and/or take possession of the instrument where found at school or elsewhere, with or without knowledge of the Renter. 6) In the event of default, Renter agrees to pay any and all costs involved in efforts to collect the balance due plus a fixed fee of one hundred dollars ($100.00) if it becomes necessary for LH/CMC or one of its agents to file a claim and/or appear in court to resolve financial claim. 7) LH/CMC is to retain full title of the above described merchandise. Renter agrees not to sell mortgage or remove from Renter’s address (given below), except for school or normal performance use. Renter agrees to notify LH/CMC in writing 30 days prior to a change of address. To remove said instrument outside these conditions or without the consent of LH/CMC may result in collection charge. 8) Upon termination of this agreement, Renter agrees to return the above described merchandise to LH/CMC place of business in the same condition less normal wear and tear. Renter acknowledges that the returned rented merchandise is subject to final inspection by the LH/CMC repair service and accounting departments. Further charges to Renter may be incurred as a result of final the inspection. All such charges will be due and payable upon notification to the renter. 9) All increases due to tax or maintenance fees increases may be added to Renter’s monthly payment. 10) Renter assumes all responsibilities, including financial liability due to any loss, damage, or theft to the above described rental merchandise. 11) This document contains the entire agreement of the parties concerning this rental and the rented merchandise. Any oral representation or modification of this agreement shall be of no force and affect unless contained in a subsequent written notification signed by both parties. Renter’s signature on this document certifies that all statements contained here are complete and authorizes LH/CMC to make any reasonable effort to verify the information given. All information on this document and all related credit reporting information will be kept strictly confidential.
*Maintenance Coverage: LH/CMC Maintenance Coverage is an added value with the rental of all instruments that covers service fees and adjustments through normal usage of the Instrument. Maintenance Coverage is not, does not cover, and should not be construed to be Insurance against loss, theft, neglect, or abuse/misuse of the rented merchandise. Renter assumes responsibility for the cost of all necessary repairs to rented merchandise. LH/CMC reserves the right to charge fees for any repairs necessary caused by neglect, abuse and/or misuse. Maintenance Coverage is deemed to be in effect only if all rental fees are paid current to date. Maintenance coverage covers certain repairs at no charge to you unless the damage is due to your willful act or negligence, in which case our standard repair rates apply. The coverage does not include damage to finishes, cosmetic damage to cases, case feet, string breakage (after the first 14 days of rental), reeds, drumsticks and mallets, heads, bow hair, rosin, brass and woodwind mouthpiece loss, neck straps, ligature loss and caps. Mouthpiece and ligature, included with instrument at time of rental, are covered upon presentation of the broken part. ALL REPAIRS MUST BE DONE BY A LA HABRA MUSIC OR CORONA MUSIC CENTERS.
