In consideration of you or your child being allowed to participate in any way in the instruction, classes, events and activities of Seung-ni Fit Club you are asked to execute this Waiver, Release of Liability and Assumption of Risk Agreement.

Physical Condition: I further acknowledge that I or my child do not have any physical limitation, medical ailments, physical or mental disabilities that would limit or prevent me or my child from safely participating in fitness programs including but not limited to, Body Sculpt, Kickboxing, Boot Camp, Lunch Crunch, Zumba, Core, Heavy Lifting, Cycling, Jumps and that I or my child are free of any communicable/infectious disease(s). I also acknowledge that before starting this or any other exercise program, consultation with a physician is recommended.

Medical Release and Insurance: In the event of an emergency, I hereby authorize transportation and licensed personnel to perform any accepted medical procedures on me or my child deemed necessary or advisable, and agree to bear the expense of any such transportation or procedures. I also understand that any treatment provided by Seung-ni Fit Club instructors or supervisors for injuries sustained will be of a first aid type only and I fully understand that the provider may not be a trained medical person. I further acknowledge that all students are required to provide their own medical insurance coverage.

Assumption of Risk: I acknowledge and fully understand that I or my child will be voluntarily engaging in activities that are inherently dangerous, involve strenuous exercise, physical contact and the risk of serious injury (including but not limited to pulls or tears of muscles or ligaments, muscle strains, broken bones, joint dislocations, hyper extensions of bones and joints, ankle, knee, hip, lower back, shoulder, elbow, wrist, finger or toe injuries, heart attacks, strokes, loss of vision, concussion and dental trauma) permanent disability or death, and may cause severe social or economic losses which might result not only from my child’s own actions, inactions or negligence, but also the action, inactions or negligence of others, the operation, supervision of management of the Seung-ni Fit Club, the Safety Rules, or the conditions of the premises or any equipment used. Further, I acknowledge that there may be other risks not known to me or the Seung-ni Fit Club or not reasonable foreseeable at this time. I hereby voluntarily assume all the foregoing risks and accept personal responsibility for all damages and/or following any injury, permanent disability or death.

Release and Waiver of Liability: I for myself or my child hereby release from, waive and discharge all actions, claims or demands that I or my child, or either of our assignees, heirs, next of kin, distributes, successors, guardians, and legal representatives now or hereafter may have for damage or losses on account of injury, including permanent disability and death or damage to property caused or alleged to be caused in whole or in part by the active or passive negligence or other acts of the Seung-ni Fit Club, its agents, employees, owners, officers, directors, instructors, affiliated entities, and other participants, their parents, guardian(s) supervisors, and instructors, and the owner, lessor, and lessees of the premises as a result of me or my child’s participation in any Academy activities, regardless of whether such activities occur on or off the premises of the Seung-ni Fit Club, I for myself or on behalf of my child hereby agree and covenant not to make a claim against, sue or attach the property of the Seung-ni Fit Club or any of its affiliated entities or above mentions parties and agree to indemnify, defend and hold the Seung-ni Fit Club free and harmless from any cost, loss or liability arising out of an injury to myself or my child.

Parent(s) or legal guardian(s) of a minor participant under the age of 18 additionally agree to instruct the minor participant of the above warnings and conditions and their ramifications, and consent to the minor's participation.

I HAVE CAREFULY AND FULLY READ THE ABOVE WAIVER, RELEASE OR LIABILITY AND ASSUMPTION OF RISKFULLY UNDERSTAND AND CONFIRM THAT I OR MYSELF OR ON BEHALF OF MY CHILD GIVE UP SUBSTANTIAL LEGAL RIGHTS BY SIGNING IT AND DO SO VOLUNTARILY, UNDER NO DURESS OR THREAT OF DURESS, WITHOUT INDUCEMENT, PROMISE OR GUARANTEE BEING COMMUNICATED TO ME. BY SIGNING BELOW, I FURTHER AGREE TO PARTICIPATE OR TO ALLOW MY CHILD TO PARTICIPATE KNOWING THE RISKS AND CONDITIONS INVOLVED AND DO SO ENTIRELY OF MY OWN FREE WILL.
